Please read all the defined rules established by The NorthBank Club provided below.

  1. In the Rules unless the context otherwise requires the following words and expressions shall have the meaning ascribed below:
    • “the Club” means The NorthBank Club.
    • “Company” means Ibraco Berhad [Registration No. 197101000730 (11286-P)] and includes its successors in title and permitted assigns.
    • “Electronic Platform” means the Club’s website, mobile applications or any other electronic or digital platform maintained by the Company, the Management  or third parties that can host the information in a secure manner for access by Member.
    • “Member” means Individual, Corporate, and where the context so admits, includes the Member’s Registered Dependants.
    • “Management” means the Company and/or any person/persons, body or corporation as may be appointed from time to time to control, manage, administer, upkeep and/or maintain the Club.
    • Registered Dependants” means the following persons subject to the approval of the Company at its absolute discretion:
      • in the case of Individual Member, the Member’s legal spouse and children below the age of twenty one (21) years living in the same abode with the Member and registered as a Registered Dependant until the child attains the age of twenty one(21) years whereupon the child shall automatically cease to be a Registered Dependent; and
      • in the case of Corporate Member, the authorised employees, directors and officers of the registered Member; and the Company may from time to time determine the maximum number of Registered Dependants that can be registered under any one Member at any one time.  

  2. “Rules” means the Rules set out herein and includes any amendment thereto, or any new rules promulgated and any by-law and regulations which the Management may from time to time draw up thereunder. In the Rules, unless the context otherwise requires:
    • Words importing the masculine gender shall include the feminine and neuter gender and vice versa.
    • Words applicable to natural persons include any body, person, company, corporation, firm or partnership, corporate or otherwise and vice versa.
    • Words importing the singular shall include the plural and vice versa.
    • The headings of Clauses in the Rules are inserted for convenience only and shall be ignored in the construction of the provisions of the Rules.
  1. The normal operating hours of the Club (Front Desk/Reception Counter) is from 7.00 a.m. to 10.00 p.m. every day (seven days a week including public holidays) or such other times as the Management may from time to time, at its sole discretion, determine. However, the normal operation hours of the management office of the Club is only from 8.30a.m. to 5.00 p.m. (Mondays to Fridays and 8.30 a.m. to 12.00 p.m. (for Saturdays) which are not a public holiday or such other times as the Management may from time to time, at its sole discretion, determine. Without prejudice to any other provisions contained in the Rules, the Management may:
    • change or vary the operation hours of the facilities within the Club from time to time at its absolute discretion;
    • at any time close the Club or any part thereof for maintenance, cleaning, renovations or repairs or for any other reason which the Management deems fit; and
    • at any time and from time to time by notice reserve the whole of or any part of the Club premises including any function rooms for any purpose whatsoever for such period or periods and subject to such provisions and limitations as to entry thereon whether by Member or any other person or class of persons and whether upon terms of payment or otherwise as the Management deems fit.
  2. The Management shall not be held liable in any way for varying the operation hours of the Club and/or facilities within the Club and/or closing the Club and/or reserving the whole of or any part of the Club premises in the manner provided under Clause 2.0(1).

(1) The Club shall have the following categories of Memberships: 

(a) Individual; and 

(b) Corporate. 

(2) A person who is applying to be a Member of the Club shall complete all details and provide documents required. Failing which, the application shall not be considered. The Company has the absolute discretion to approve or reject any application for membership. Without prejudice to other legal and equitable rights and remedies of the Company, the Company reserves the right to immediately: 

(a) suspend the membership of any Member who is subject to investigation for breaching the Rules; or 

(b) terminate the membership of any Member who committed an offence under the Rules (which the Management is of the view that it is a serious offence) or committed an offence which incapable of remedy or an offence which is capable of remedy, but fail to remedy the said breach within fourteen (14) days from the date of notice from the Management; 

without any liability on the Company. Upon the suspension or termination of the membership of any Member pursuant to this Clause, the privilege granted to his/her Registered Dependants to use the facilities of the Club will be automatically suspended or terminated, as the case may be. 

(3) In the event of death of an Individual Member, the next-of-kin shall provide the Management a certified photocopy of the Death Certificate, Probate or Letter of Administration and such other documents that the Management may request from time to time as soon as possible for administrative purpose. Unless otherwise approved in writing by the Company at its absolute discretion, the membership is not transferrable and in the event of the death of an Individual Member, it shall be the duty of the deceased Member’s next of kin to terminate the membership and notify the Company in the manner provided under Clause 3.0(6). For clarity, the heirs, personal representatives, permitted assigns and successors in title (as the case may be) of the Member shall always be liable for any antecedent breach of the deceased Member. 

(4) Upon the approval of the membership application, the Member shall pay the necessary deposit prescribed by the Company and provide digital image of the face of the Member and his/her Registered Dependants (if any) to enable them to enter the Club using the face recognition system. The deposit is only refundable to Member free of interest in the event there is no antecedent breach by the Member during the subscription term. 

(5) The Member is required to create an online account using the designated Electronic Platform and the Member shall be solely responsible to keep its account including the user names, passwords and other access codes) secure. The Management may rightfully assume that any person using the designated Electronic Platform with the Member’s account is the Member (not the Registered Dependant or any unauthorised third party) and all transactions executed or done by the Management pursuant to the Member’s instruction made through the designated Electronic Platform shall be binding on the Member. In this regard, the Member agrees that no claims shall be made by the Member or on his/her behalf in respect to any losses, costs and expenses incurred by the Member as a result of such unauthorized usage. 

(6) Unless otherwise approved by the Company at its absolute discretion, the subscription and renewal as a Member and Registered Dependant (referred to in Clause 4.0) are on annual basis. In the event that any or all of the subscriptions is terminated by the Company due to the default of the Member or unilaterally terminated by the Member before the expiry of the subscription term (other than due to the death of an Individual Member or Registered Dependant provided that there is no antecedent breach), the Company shall be entitled to forfeit the relevant deposits as pre-estimated liquidated damages without prejudice to other rights and remedies in relation to antecedent breach (if any). Any Member who unilaterally terminates any or all of the subscriptions before the expiry of the subscription term may be barred from re-joining the Club membership in the future and/or such other action as the Company deems fit at its absolute discretion. Any termination shall be in written form and shall only take effect upon the acknowledgement by the Company or the date specified in the termination notice (whichever is the later). 

(7) The Management shall maintain a computerised database register by Membership Number, Full Name, Identification Card Number, digital image and other data as the Management deems fit in order to administer the above accurately and effectively. 

(8) Monthly subscriptions fees at the rate prescribed by the Company from time to time shall be chargeable from a date to be fixed by The Company and shall thereafter be payable on or before the seventh (7th) day of each and every calendar month (whether formally demanded or not). 

(9) Without prejudice to other legal and equitable rights and remedies of the Management, payment of any sum payable to the Management under this Rules after the due date will be subject to late payment interest at the rate of 1.5% per month calculated on a daily basis. 

(10) For clarity, the Company is providing the Member the right to use and enjoy the Club’s facilities subject to the Rules in consideration for the Member paying the prescribed fees and the Member is neither the holder of the Company’s shares or debentures nor making investment in the Club or the Company where the Member acquires or may acquire an interest or right in respect of the Club or the Company. Hence, it is not an unlisted recreational club (as defined under Section 2 of the Capital Markets and Services Act 2007) and a scheme governed under the Interest Schemes Act 2016. 

(1) Registered Dependants shall be entitled to enjoy the Privilege in accordance with the Rules. For clarity, in addition to the subscription fees and deposit for Member, the Member shall pay for the prevailing subscription fees and deposit prescribed by the Company for the Registered Dependants. The deposit for Registered Dependant (if any) shall only refundable to the Member free of interest upon the expiry or termination of the subscription provided that there is no antecedent breach. 

(2) The Member shall at all times be responsible and liable for the conduct and behaviour of his/her Registered Dependants including but not limited to any expenses or charge incurred by the Registered Dependants. Any breach of the Rules by a Registered Dependant shall be deemed to be a breach committed by the Member concerned. All damage or injury to the property of the Club or other persons in the Club caused by any Registered Dependant shall be made good at the expense of the Member concerned. The Member shall indemnify and keep indemnified the Company against all claims and actions arising from the conduct or act of his/her Registered Dependants and on any breach of the Rules by his/her Registered Dependants. 

(3) The Management reserves the right to withdraw the Privilege of any Registered Dependants to use the Facilities of the Club or any part thereof as the Management deems fit. 

(4) Persons under the age of eighteen (18) years shall not smoke or consume alcoholic beverage in the Club premises. 

(1) Subject to the other provisions of the Rules, the Member and/or Registered Dependant of twelve (12) years old or above may bring in and accompany guest(s) at the Club PROVIDED ALWAYS that the guest(s) must be registered at the Reception Counter or through the designated Electronic Platform by the Member (not the Registered Dependant) and pay the guest fees prescribed from time to time, failing which the Member will be charged twice the amount of guest fees payable. For clarity, the Management shall have the right to deny entry of any guest(s) including but not limited to any person whose membership or privilege is suspended or terminated pursuant to Clause 3.0(2) of the Rules. The guest(s) brought in by the Registered Dependant shall be deemed as the Member’s guest(s) notwithstanding that the guest(s) is not accompanied by the Member. 

(2) A Member shall be responsible for the guest(s) he/she and/or his/her Registered Dependant brought to the Club and shall be liable to pay to the Company for guest fees, all debts, costs and damages incurred or caused by his/her guest(s). 

(3) A Member shall ensure that his/her guest(s) comply with the Rules of the Club. 

(4) Subject to Clause 5.0(5), guests may use the Club facilities (except for the gym) provided they are accompanied by their Member-host. Each Member shall be responsible for the conduct of his/her guests. 

(5) The Management may from time to time impose limitations on the facilities that can be used by the guests as well as in numbers and in frequency of guests a Member can bring to the Club. Without prejudice to the generality of the foregoing and unless otherwise approved or amended by the Management at its absolute discretion, the Member (which includes the Registered Dependants of 12 years old or above) shall only be permitted to bring a maximum of four (4) guests in aggregate to the Club at any one time. 

(6) The Registered Dependant of twelve (12) years or above but not of the age of eighteen (18) or above shall not be permitted to bring in and accompany any guest(s) which is below the age of twelve (12). 

(1) The Club premises and all the facilities and equipment provided shall remain at all times the property of the Company. No Member shall take away or permit to be taken away from the Club premises, any property of the Club belonging to the Company under any circumstances, damage or vandalise any property of the Club and the Member shall indemnify the Company against such loss or damage to the Club or its property caused by him/her or any of his/her Registered Dependants or guests.

(1) No advertisement shall be allowed to be placed in any part of the Club premises without the prior written approval of the Management, which the Management shall have the absolute discretion to withhold the approval. 

(2) The Management may as a condition for granting permission for putting up of an advertisement or notice, impose a levy of such amount or as the Management shall see fit. 

(1) Unless expressly authorized by the Management in writing, no Member or Guest shall: 

(a) Participate in any form of gambling within the Club premises; 

(b) Bring on or introduce to the Club any noxious or dangerous substances; 

(c) Use any radio, tape player or any other musical instruments in the Club so as to cause a nuisance or annoyance to other Members therein; 

(d) Give any loan to any employee of the Club or the Company; 

(e) Bring into the Club or consume therein any food or drinks unless the same shall have been purchased from the Club’s food and beverage outlets; 

(f) Indulge or engage in any form of political activity, demonstration, protest or campaigning within the Club premises; 

(g) Reprimand or in any way censure an employee of the Management other than by written complaint addressed to the Club manager; and/or 

(h) Indulge or engage in any obscene or unruly behaviour whilst on the Club premises. 

(2) In addition to Clause 8.0 (1) above, no Member or guest shall: 

(a) Vandalise or wilful damage any property belonging to the Club, Company, Management, Member or guests; 

(b) Engage in fighting, intimidation, assault, battery or any form of threatening behaviour in the Club; 

(c) Publish and/or circulate inflammatory or defamatory statement (either in written or verbal form) which are prejudicial to the interests of the Club; 

(d) Possess, solicit or use drugs or any illegal substances under the law of the country; 

(e) Smoke in non-smoking area of the Club; 

(f) Engage in theft or any criminal act; and/or 

(g) Engage in any omission or conduct which in any ways brings disrepute upon the Club, its Member or any person working at the Club. 

(1) No gratuity, money or tipping in any form may be given to any employee of the Club unless authorised by the Management. 

(2) Member and Guests shall at all times: 

(a) Conduct themselves with decorum and observe courtesy and rules of etiquette while in the Club premises; 

(b) Do not discriminate on the ground of age, gender, disability, race, ethnic origin, nationality, colour, parental or marital status, religious belief, class or social background, sexual preference or political belief; and 

(c) In the appropriate attire prescribed by the Rules when using the facilities of the Club. 

(3) Member and Guests shall park their cars or vehicles in an orderly manner and in designated parking lots, more particularly set out in Clause 22.0 and Clause 23.0. 

(4) Member shall ensure that his/her children and his/her guest below the age of twelve (12) shall at all times be under the control and supervision of the adult Member of at least eighteen (18) years old and shall ensure that his/her Registered Dependant or guest shall not cause annoyance to other Members and guests of the Club. 

(5) No Member or Guests shall remove any newspaper, magazine, periodicals or other movable property at the Club without prior written permission of the Management. 

(6) Any Member or his/her Guests breaking or damaging the property of/at the Club shall pay to the Management the cost of making good the damages. The amount of such cost shall be assessed by the Management whose decision shall be final. 

(7) Member and Guests shall refrain from making any noise causing any nuisance or doing any act of thing which may in the opinion of the Management, create annoyance to others. 

(8) No Member or Guests is allowed to enter the service rooms, kitchens, filtration plant, pump room and all other rest areas including but not limited to prohibited areas under any pretext whatsoever unless otherwise permitted by the Management in writing. 

(9) No Member or Guest shall display any posters, notices, etc., in any part of the Club without the prior written permission of the Management. 

(10) No Member or Guest shall bring to any part of the Club premises any firearms except for a Member who is an armed force personal on duty. 

(11) No Member or any persons shall be permitted to sell and/or transact for cash consideration or/or any other form of payment any sporting goods, equipment and related merchandise for swimming, badminton, basketball, netball and other sports within the Club premises and compound. 

(12) Sports equipment which are not approved by the Management shall not be allowed to be used in the Club. 

(13) No Member or Guest shall bring any pets or domestic animal into the Club premises. 

(14) Members, guests and other patrons are also reminded that the Club being a family club there will be children at the Club premises. Extra care should be taken by Members, and guests are not to use abusive, vulgar or obscene language or any form of profanity or other words or language that may be deemed rude or bad influence toward other Members, guests or employees of the Club. 

(15) The unrestrained and excessively loud use of coarse/ profane / obscene language in and around the Club is prohibited. Unrestrained and excessively loud coarse/profane/obscene language is deemed to upset the peace and tranquillity and as such is not permissible. 

(16) No servant of the Members, or guests shall be permitted to use any of the facilities and amenities of the Club, unless they are registered as paying guests. 

(17) No Member or his/her guest(s) shall litter in the Club, or leave any waste rubbish or anything whatsoever brought in by him/her or his/her guest(s) into the Club. 

(18) Neither the Company nor the Management shall be liable for the loss or damage to any property brought into the Club by a Member or his/her guest. Member and guest who leave articles or clothing or personal belonging in any part of the Club shall do so at their own risk. 

(19) Neither the Company nor the Management shall be liable for any injury or damage whatsoever, by whomsoever caused to a Member, his/her guests, or to any other person. 

(1) Opening Hours 

Open daily from7.00 a.m. to 10.00 p.m. 

The Management shall have full control over the gym and may at any time vary the opening hours of the gym or may open, close or reserve the Gym or any part thereof for such period and purpose, including but not limited to tournaments, exhibitions and repairs, as the Management shall deem fit by posting a notice on the Electronic Platform or the notice board of the gym or the Club. 

(2) General Rules 

(a) All Members and Registered Dependants of at least sixteen (16) years old upon registration as gym members are allowed to use the gym subject to payment of appropriate fees and deposit (if any) prescribed by the Company from time to time. For clarity, the gym membership fees are not included in the membership subscription fees and the gym membership is optional. The deposit (if any) for gym membership shall only be refundable to the Member free of interest upon the termination of the gym membership provided that there is no antecedent breach.

(b) No Members are allowed to bring guests into the gym and no guests shall be permitted to use the gym.

(c) Members wishing to use the gym are advised to consult their doctors and/or seek the advice of a competent and qualified physical instructor before using the gym equipment.

(d) Any Members on finding a malfunction of any equipment should report the matter immediately to the Club’s Sports Co-ordinator or the Customer Service Administrator.

(e) Members are not allowed to exercise bare bodied.

(f) Non-marking sport/athletics shoes shall be worn.

(g) Smoking, including electronic cigarettes and vaping is strictly prohibited in the gym.

(h) No food or beverage shall be consumed or taken into the gym except drinking water.

(i) Gym members shall be properly attired in standard workout clothes and gym wear. Swimming attire, jeans and wet clothing are not permitted in the gym.

(j) Directions and instructions from the Club’s Gym Instructor and/or Sports Co-ordinator shall be complied with. All weights and dumbbells and movable equipment are to be returned to the original place after use.

(k) Gym user should bring along a personal towel to wipe off his/her sweat on the gym equipment and sanitize the equipment with the sanitizer that is provided by the Club after each use for the convenience of other user.

(l) Members should not tamper with any electrical items, fixtures and fittings.

(3) Exercise and/or Fitness Classes

(a) Exercise and/or fitness classes may be conducted by the Club’s qualified and authorized coaches or instructors only.

(b) All registration fee and payments charged for such classes (if any) shall be transacted at the Club Reception Counter or through the designated Electronic Platform. No payment shall be made directly to the coaches or instructors.

(4) Liability

The Management will not be held responsible in any way for any injuries or mishaps that may occur in the gym howsoever caused other than by the wilful or negligent act of the Management.

(1) Opening Hours 

Open daily from 8.00 a.m. to 10.00 p.m. 

The Management shall have full control over the courts and may open, close or reserve the same for such period and purpose, including but not limited to tournaments, exhibitions and repairs, as the Management shall deem fit by posting a notice on the Electronic Platform or the notice board of the courts or the Club. 

(2) General 

(a) All children under the age of twelve (12) years are not allowed to use the courts except accompanied and supervised by an adult Member of at least eighteen (18) years old. 

(b) Proper attire shall be worn on the courts, no players shall be without shirt. 

(c) Flat-soled shoes with non-marking soles shall be worn. Shoes with studs or spikes or black soles such as jogging shoes shall not be permitted. 

(d) Only approved types of equipment shall be used. Racquets with sharp edges shall not be permitted. 

(e) Smoking, including electronic cigarettes and vaping is strictly prohibited in the courts. 

(f) No food or beverage shall be consumed or taken into the courts except drinking water. 

(3) Booking Procedures 

(a) Member can make bookings either in person at the Reception Counter, or over the telephone or through the designated Electronic Platform. The booking shall only be 

deemed to be confirmed after the Management confirms the available slots and the Member paid the prescribed fees in advance. 

(b) Booking may be made up to seven (7) days in advance for a period of two (2) hours only in the same day. 

(c) As a courtesy to other Members, players shall promptly vacate the courts when their session of play ends. Subject to the availability of courts, an extension of a maximum of one (1) hour court time may be made at the Reception Counter or the designated Electronic Platform after the completion of the session. 

(d) If the member reserving the court does not occupy it within ten (10) minutes after the time stated in the booking without prior notification, the Management reserves the right to release the booking. 

(e) Any cancellation shall be communicated to the Management with at least four (4) hours’ notice period before the start of the booking, failing which the fees paid in advance during the booking shall be forfeited. In addition to the foregoing, the Management reserves the rights to bar the Member from booking the courts up to two (2) months in the event the Member repeatedly fails to cancel the booking of the courts in the manner provided in this Clause 11.0(3)(e). For clarity, any booking made by the Registered Dependant shall be deemed to have been made by the Member and any failure to cancel the booking in the manner provided under Clause 11.0(3) shall be deemed to be an offence committed by the Member. 

(4) Guests 

(a) Guests are required to be signed in by Members at the Reception Counter or the designated Electronic Platform prior to the commencement of play, failing which the Member will be charged twice the amount of guest fees payable. 

(b) Member shall play with his/her guests. A guest shall not be allowed to play or continue to play in the event the introducing Member is absent. 

(5) Trainings / Lessons 

(a) badminton, table tennis, basketball, netball and/or such other suitable trainings or lessons may be conducted by the Club’s qualified and authorized coaches or instructors only. 

(b) All registration fee and payments charged for such trainings or lessons shall be transacted at the Club Reception Counter or the designated Electronic Platform. No payment shall be made directly to the coaches or instructors. 

(6) Liability 

The Management will not be held responsible in any way for any injuries or mishaps that may occur in the indoor court and/or outdoor multi-court howsoever caused other than by the wilful or negligent act of the Management. 

(1) The swimming pool facility comprise of the following facilities or such other facilities as the Management may determine from time to time: 

(a) 50 meters Olympic-length swimming pool; 

(b) Children’s pool. 

(2) Opening Hours 

Open daily from 7.30 a.m. to 9.00 p.m. 

The Management shall have full control over the swimming pool and may vary the operation hours, open, close or reserve the swimming pool or any part thereof for such period and purpose, including but not limited to tournaments, exhibitions and repairs, as the Management shall deem fit by posting a notice on the Electronic Platform or the notice board of the swimming pool or the Club. 

(3) General 

(a) No person is allowed to swim or sunbathe without swimming attire. Only swimming attire which are approved by the Management may be worn and, in this respect, the Management’s decision shall be final. 

(b) All persons shall change into their swimming attire at the changing room only, including children. 

(c) All persons shall shower before entering the pool and wash his/her feet each time he/she re-enters the pool. 

(d) Persons suffering from any infections, communicable or contagious disease shall not use the pool. 

(e) Spitting or any other unhygienic acts in or around the pools or deck are prohibited. 

(f) No person who is under the influence of alcohol or drugs or any other form of intoxicating substance shall use the pools. 

(g) No person shall consume food and drink in or near the edge of any of the pools. 

(h) Member’s children of twelve (12) years old or above but below eighteen (18) years of age who use the swimming pool facilities unaccompanied by a parent/legal guardian shall be deemed to have obtained a consent from the Member to use the swimming pool unaccompanied by the said parent/legal guardian. The Member agrees to indemnify the Management in the event of any loss of life or personal injury to the Member’s children concerned. 

(i) Member’s children who are under eighteen (18) years of age but at least twelve (12) years of age who use the facilities together with guests of twelve (12) years or above shall also be deemed to have obtained consent from the Member for the usage of the swimming pool by the Member’s children and guests. 

(j) The Member concerned hereby agrees to indemnify the Management against any claims whatsoever by the parent/Legal Guardian or next of kin of any parties in the event of loss of life or personal injury to the Member’s children and/or guests brought by his or her children to the swimming pool. 

(k) The use of the children’s pool shall be confined to children under the age of twelve (12) years and shall be at all times be accompanied and supervised by an adult Member of at least eighteen (18) years old. 

(l) No child under the age of twelve (12) years shall be at any time be near or allowed to use the pool unless accompanied and supervised by an adult Member of at least eighteen (18) years old. 

(m) Only appropriate footwear which are approved by the Management may be worn on the pools deck and, in this respect, the Management’s decision shall be final. 

(n) All running, pushing, horseplay, dunking or any form of “rough/dangerous play” within the vicinity of and/or in the pool are strictly prohibited. 

(o) All users of the pools are prohibited from using the pools when it is raining and whenever there are thunderstorms/lightning or under other life threatening or emergency situation or circumstances and shall do so immediately when directed or instructed by any personnel authorised by the Management with long whistle blasts. 

(p) Every Member is responsible for his/her own safety and that of his/her guests and all members of the his/her family. 

(q) The use of rubber, water gun, air mattresses, toys, balls, kicking board, flippers and any other forms or types of swimming aids are not permitted except arm rings and floats for children. Users under supervised coaching sessions are permitted to use flippers and kicking boards. 

(r) The pool filtration, mechanical and electrical are strictly out of bounds to any person except for the authorized personnel. 

(s) The water slide at the children’s pool is strictly for children and adults are not allowed to use the same. 

(t) Smoking, including electronic cigarettes and vaping is strictly prohibited in the pools and around the pool area. 

(u) Members or guest shall not interfere with any fittings, equipment or machinery of any kind used on connection with or around the facilities areas of the swimming pools, or other ancillary. 

(v) The use of the swimming pool is strictly prohibited during closing hours. 

(w) The Management will not be held responsible in any way for any injuries or mishaps that may occur within the vicinity of and/or in the swimming pool howsoever caused other than by the wilful or negligent act of the Management. 

(4) Guests 

(a) Guests are required to be signed in by Members at the Reception Counter or the designated Electronic Platform prior to the use of the pool, failing which the Member will be charged twice the amount of guest fees payable. 

(b) All Members who bring guest shall be liable to the Management for all monies due to the Management incurred by the Guest and shall also be responsible for the guest’s proper conduct and due observance of the Club Rules. 

(5) Training / Lessons 

(a) Swimming, lifesaving and/or other aquatics trainings or lessons may be conducted by the Club’s qualified and authorized coaches or instructors only. 

(b) All registration fee and payments charged for such trainings or lessons shall be transacted at the Club Reception Counter or the designated Electronic Platform. No payment shall be made directly to the coaches or instructors. 

(1) Opening Hours 

Open daily from 7.30 a.m. to 9.00 p.m. 

The Management shall have full control over the children’s water playground and may vary the operation hours, open, close or reserve the children’s water playground or any part thereof for such period and purpose, including but not limited to tournaments, exhibitions and repairs, as the Management shall deem fit by posting a notice on the Electronic Platform or the notice board of the children’s water playground or the Club. 

(2) General 

(a) Members are always responsible for the safety of their children. A child under twelve (12) years of age shall be accompanied at all times by an adult Member of eighteen (18) years old or above. 

(b) No running, jumping, pushing or rough play allowed. 

(c) No food or beverage shall be consumed or taken into the children’s water playground except drinking water. 

(d) No spitting, spouting water from the mouth, and blowing the nose at the children’s water playground. 

(e) No toys or water balloons are allowed in the children’s water playground. 

(f) Smoking, including electronic cigarettes and vaping is strictly prohibited at the children’s water playground. 

(1) Facilities 

The changing room facilities may comprise the following facilities or such other facilities as the Management may determine from time to time: 

(a) Shower rooms; 

(b) Lockers; and 

(c) Changing cubicles. 

(2) Opening Hours 

Open daily from 7.00 a.m. to 10.00p.m. 

The Management shall have full control of the changing room and may at any time, vary the operation hours or may open, close or reserve the changing rooms or any part of the changing rooms facilities for such reason as the Management shall deem fit by posting a notice on the Electronic Platform or the notice board of the changing room or the Club. 

(3) General 

(a) Smoking, including electronic cigarettes and vaping is strictly prohibited in the changing rooms and all of its facilities. 

(b) Boys who are five (5) years old or above are not allowed in the ladies’ changing room and no girls is allowed in the men’s changing room. 

(c) Lockers are available to Members free of charge on a first come first serve basis. 

(d) Members shall keep lockers clean and tidy at all times and no articles shall be left overnight in lockers which are designated for daytime use only. 

(e) Storage of food-stuff, weapons, banned publications, illegal drugs etc. in lockers are prohibited. 

(f) Members are entirely responsible for articles deposited in the lockers or left in the changing rooms. Any articles found after 10.00 p.m. will be removed without any liabilities on the Management. 

(g) Neither the Company nor the Management will be responsible/liable for any loss or damage to any articles deposited in lockers by Members or their guests.

The Management shall have full control of the children’s library/play room and may at any time, vary the operation hours or may open, close or reserve the children’s library/play room or any part thereof for such reason as the Management shall deem fit by posting a notice on the Electronic Platform or the notice board of the children’s library/play room or the Club. 

(2) General 

(a) Children below the age of twelve (12) shall be accompanied by an adult Member of eighteen (18) years old or above at all times. 

(b) Smoking, including electronic cigarettes and vaping is strictly prohibited. 

(c) No food or beverage shall be consumed or taken into the children’s library/play room except drinking water. 

(d) Swimming attire and wet clothing are not permitted in the children’s library/play room. 

(e) No shoes/slippers are allowed in the children’s library/play room. 

(f) Any child who is sick or suffering from any contagious disease may not be allowed to enter the children’s library/play room. 

(g) No dangerous or sharp objects may be taken into the children’s library / play room. 

(h) No shoving, chasing, rough play, playing balls with racquets or engaging in throwing games 

(i) No using of loud, foul or abusive language. 

(j) Children may bring games (electronic/non-electronic), books and other safe materials into the children’s library/play room. 

(k) Any toy brought in by a child which is considered dangerous may be confiscated from the child and returned to the accompanying adult Member. 

(l) Members or guests are not allowed to borrows or bring out books or other reading materials. 

(m) All reading materials shall be returned to their original place after use. 

(n) Members or guests shall not tear, mutilate, deface or abuse any of the reading materials. 

(o) Users shall not tamper with any equipment, fixtures and fittings etc. 

(p) Children who cause disturbance or annoyance to other children may be asked to leave the room. 

(q) Members shall be responsible for the safety of their children, their guests and their belongings in the children’s library and play room. 

(r) The children’s library / play room’s furniture or materials are not to be removed from the room. 

(s) All complaints or suggestion shall be in writing to the Management. 

(t) Members shall be liable for any damage to the furniture, equipment, fixture and fittings, or loss of reading materials.

(u) The Management will not be held responsible in any way for any loss, illness, accident, harm or fatality arising from using the children’s library / play room facilities. 

(1) Opening Hours 

Open daily from 9.00 a.m. to 10.00 p.m. 

The Management shall have full control over the study room and may vary the operation hours, open, close or reserve the study room or any part thereof for such period and purpose, as the Management shall deem fit by posting a notice on the Electronic Platform or the notice board of the study room or the Club. 

(2) General 

(a) Study room is for study and group project discussion purposes only. 

(b) Study room is not intended for group meals, activities such as crafts that require cleaning up, or storage of personal items. 

(c) No food or beverage shall be consumed or taken into the study room except drinking water. 

(d) Smoking, including electronic cigarettes and vaping is strictly prohibited in the study room. 

(e) Swimming attire and wet clothing are not permitted in the study room. 

(f) The Study room furniture are not to be removed from the room. 

(g) Members shall be liable for any damage to the furniture, equipment, fixture and fittings. 

(h) Members shall be responsible for the safety of their children, their guests and their belongings in the study room. Children under twelve (12) years of age shall be accompanied at all times by an adult Member of at least eighteen (18) years old. 

(i) The Management will not be held responsible for any loss or damage of goods or property left in the study room by any persons. Such goods or property are left on the premise is at owner’s risk. 

(1) Opening Hours 

Open daily from 9.00 a.m. to 10.00 p.m. 

The Management shall have full control of the games room and may at any time, vary the operation hours or may open, close or reserve the games room or any part thereof for such reason as the Management shall deem fit by posting a notice on the Electronic Platform or the notice board of the games room or the Club. 

(2) General 

(a) Smoking, including electronic cigarettes and vaping is strictly prohibited in the games room and all of its facilities. 

(b) Swimming attire and wet clothing are not permitted in the games room. 

(c) No food or beverage shall be consumed or taken into the games room except drinking water. 

(d) All equipment, board games, fixtures and furniture are not to be removed or taken out of or from the games room. 

(e) Any child who is sick or suffering from any contagious disease may not be allowed to enter the games room. 

(f) No dangerous or sharp objects may be taken into the games room. 

(g) No shoving, chasing, rough play, playing balls with racquets or engaging in throwing games. 

(h) Children who cause disturbance or annoyance to other children may be asked to leave the room. 

(i) Members shall be responsible for the safety of their children, their guests and their belongings in the games room. Children under twelve (12) years of age shall be accompanied at all times by an adult Member of at least eighteen (18) years old. 

(j) Members shall be liable for any damage to the equipment, board games, fixtures and furniture. 

(1) Classes booking may be made at maximum 4 days in advance.

(2) If three classes are booked and not attended consecutively within a two-week period, that person will only be allowed to do the next booking 24 hours in advance for the next two-weeks period.

(3) Punctuality is encouraged. If you are more than 10 minutes late, you will miss the whole warm-up.

(4) If monthly fees are not settled in the required time, access to the Studio classes may be blocked.

(5) For member/guest who opt for pay-per-entry, fee must be settled upon booking. There will be no refund or class-replacement, and it is non-transferable, if cannot attend.

(6) A member may register one guest for a class but the per-entry class fee plus the Club guest entrance fee will apply.

(7) All cancellations for classes must be notified to the Club at minimum 2 hours in advance before the start of evening classes, and by 8pm the night before the morning classes.

(8) If cancellation rule 7 is not followed, then any last-minute cancellation will be treated as a no-show and rule 2 will apply.

(9) Classes are subject to change and may be cancelled or substituted at any time.

(10) If less than 3 slots are booked for a class, the class will be cancelled. Anyone who has paid for the class on the pay-per-entry system will be allowed to replace the class to another day.

(11) Walk-in on the day is subject to availability of slots.

(12) Members aged 12 years and above can attend classes, but if less than 16 years old, must obtain parental consent.

(13) Please bring your own mats and drinking water to the Studio.

(14) Clean and dry footwear is required in the Studio.

(15) Please put all phones on silent mode during class.

The Management shall have full control of the children’s outdoor playground and may at any time, vary the operation hours or may open, close or reserve the children’s outdoor playground or any part thereof for such reason as the Management shall deem fit by posting a notice on the Electronic Platform or the notice board of the children’s outdoor playground or the Club. 

(2) General 

(a) Members are always responsible for the safety of their children and their guests. Children under twelve (12) years of age shall be accompanied at all times by an adult Member of at least eighteen (18) years old. 

(b) Smoking, including electronic cigarettes and vaping is strictly prohibited in the playground. 

(c) No food or beverage shall be consumed in the playground except drinking water. 

(d) Members will be responsible for the cost of any item damaged by their children and their guests. 

(e) Children suffering from any infections, communicable or contagious disease shall not be allowed to use the playground. 

(f) No shoving, chasing, rough play, playing balls with racquets or engaging in throwing games. 

(g) No using of loud, foul or abusive language. 

(h) The Management may at its discretion not allow any child’s usage of the children’s playground without assigning any reason whatsoever. 

(i) The Management may not be responsible or liable for any missing child, injuries or death caused to any child by any reason whatsoever. 

No outside food and/or drinks are allowed in the Club without prior written approval from the Management. Such approval shall in any case be limited to baby food or food for medical reasons only. 

(1) Opening hours 

Open Daily from 10.00 a.m. to 10.00 p.m. 

The orders shall be taken no later than half an hour before closing time. 

The Management shall have full control of the restaurant and cafe/alfresco (the dining room) and may at any time, vary the operation hours or may open, close or reserve the same or any part thereof for such reason as the Management shall deem fit by posting a notice on Electronic Platform or the notice board of the restaurant and cafe/alfresco (the dining room) or the Club. 

(2) Dress Code 

Persons in swim attire, wet swimming attire or wet clothing are prohibited from entering into the restaurant and cafe/alfresco (the dining room). 

(3) Reservation 

(a) Tables in the restaurant and alfresco may be reserved by telephone. Reservations will be accepted on a first come first serve basis, and does not include choice of table. 

(b) A booking for table/tables not taken up fifteen (15) minutes without any notification after the reserved time will be deemed to have been cancelled without notice. 

(1) Opening hours 

Monday – Thursday & Sunday 10.00 a.m. to 10.00 p.m. 

Friday, Saturday and Holiday Eve 10.00 a.m. to 11.00 p.m. 

The Management shall have full control of the wine bar and may at any time, vary the operation hours or may open, close or reserve the same or any part thereof for such reason as the Management shall deem fit by posting a notice on the Electronic Platform or the notice board of the wine bar or the Club. 

(2) Corkage 

Corkage for every bottle of wine and/or liquor will be charged at a fee to be determined by the Management. 

(3) Dress Code 

Persons in swim attire, wet swimming attire or wet clothing are not allowed to enter the wine bar. 

(1) The Car park access is using Vehicle License Plate Recognition System 

(2) Subject to the availability of parking space, a Member is entitled to two (2) free parking at any one time provided the said vehicles are registered with the Management. Any other vehicles of the Member and guest shall subject to the prevailing parking fees imposed by the Company from time to time. 

(3) All vehicles shall be parked at the owner’s own risk and in an orderly manner and within the lines drawn for parking of vehicles. 

(4) The Management reserves the right to clamp vehicles which are in violation of this Rules. 

(5) A vehicle that is clamped can only be released upon a prescribed fee being paid. 

(6) Washing of cars/vehicles is not permitted on the car park. 

(7) No car shall be permitted to parked overnight at the car park. 

(8) All drivers of any vehicles entering into the Club premises shall obey these Rules, observe all rules of etiquette and accord due courtesy to Members and other Visitors to the Club, not cause any obstruction to any Party and comply with all other such regulations as may be enforced by the Management from time to time. 

(9) The Management and its staff are not liable to any vehicle owner for any personal injury, loss of property, and other loss and damage, cost and action whatsoever or howsoever incurred or suffered by the vehicle owner or his passengers due to the use of the car parking bays or actions taken by the Club’s staff for infringement of this by-law. 

(1) Motorcycles and bicycles are to be parked at the designated motorcycles parking areas and bicycles racks. Motorcycles and bicycles parked on the Club premises are at owners’ risk and the Management is not responsible for any loss or damage. 

(2) Other than the designated places stated in Clause 23.0(1), motorcycles and bicycles are not to be brought inside the Club Premises. 

(3) Motorcycles and bicycles left on the Club premises for a continuous period of more than two (2) days shall be considered abandoned and subsequently removed. The Management shall have the absolute power and authority to remove or dispose of abandoned motorcycles and bicycles in any ways it deems fit. 

(4) If a motorcycle or bicycle is found to be indiscriminately parked, a notice shall be placed on the motorcycle or bicycle stating violation of the Club’s motorcycles or bicycles parking policy. The notice shall instruct the owner to remove the motorcycle or bicycle within 24 hours from time of the issuance of the notice, failing the Management shall have the absolute power and authority to remove or dispose of the motorcycle or bicycle in any ways it deems fit. A motorcycle or bicycle shall be deemed indiscriminately parked when it is: 

(a) Creating an obstruction such as blocking an entrance, an exit or walkway; 

(b) Creating an immediate hazard or damaging Club property, including tainting the walls with tyre markings; 

(c) Secured to a hand rail; 

(d) Occupying a facility reserved for persons with disabilities; 

(e) Parked in any area other than the designated racks for bicycle parking or motorcycle parking, as the case may be; and/or 

(f) Parked overnight without prior permission obtained. 

(5) The Management shall not be liable for any cost incurred from replacement, loss and/or damage resulting from the removal or disposal of the abandoned motorcycles and bicycles or indiscriminately parked motorcycles and bicycles. 

(1) Use of all the other facilities of the Club shall be subject to such rules, regulations and by-laws as the Company may prescribe and amend from time to time in the manner set out in Clause 25.0. 

(2) The Company may from time to time at its absolute discretion appoint, delegate, assign or subcontract to any person, firm or company to operate and/or manage any part of the facilities of the Club upon such terms and conditions as the Company may deem fit. 

The Management may from time to time, add to, alter and repeal the Rules and/or create or amend additional by-laws and regulations By-Laws for the regulation of the affairs of the club. Such By-Laws so made, added to, altered or repealed shall come into operation and binding on members after they have been posted in the Electronic Platform for fifteen days. 

(1) Unless otherwise stated herein, Notices or documents in hard copies may be given by the Company or the Management to any Member either personally or by post to him in a prepaid mail addressed to him/her at his/her last known address in Malaysia. Notices or documents given in electronic form shall be transmitted to the last known electronic mail address or by publishing on the Electronic Platform. 

(2) Unless otherwise provided herein, any notice or other document if served: 

(a) personally, shall be deemed to be served on the date the notice was personally delivered to the Member; 

(b) by post, shall be deemed to be served or delivered at the time when the letter containing the same is put into the post, and in proving such service or sending it shall be sufficient to prove that the letter containing the notice or document was properly addressed and stamped and put into a post office or into any post box as a prepaid letter; and 

(c) in electronic form, shall be deemed to be served or delivered at the time of transmission to a Member’s last known electronic address or on the date the notice or document is first made available on the Electronic Platform. 

(1) Use of the Club’s facilities shall be at the sole risk of the Members, and their registered Dependants and guests. The Company and the Management shall not in any way be responsible for any personal injuries, loss of life or loss of property or such other loss occurring, in whatsoever manner or for whatever reason, as a result of the use of the Club’s facilities other than caused by the wilful or negligent act of the Management. The Member acknowledges that it is impractical for the Management to monitor the usage of the Club’s facilities by the Member (including the Registered Dependant) and/or the guest at all the times. Hence, the Member shall be solely responsible to monitor, supervise and control his or her Registered Dependant and/or guest even if they are not accompanied by the Member concerned. 

(2) The Member shall fully indemnify, defend and hold the Company and/or the Management harmless from and against all claims, demands, costs, losses, expenses and liabilities (including full legal costs on an indemnity basis) arising out of or in any way connected with the Member and/or guest’s act or omission, failure, default or breach of his/her obligations under this Rules. 

(3) In addition to the above, the Member shall fully indemnify, defend and hold the Company and/or the Management harmless from and against all claims, demands, costs, losses, expenses and liabilities (including full legal costs on an indemnity basis) arising out of or in any way connected with claims made by his/her Registered Dependant and/or guest. 

(1) General 

(a) The Company recognizes the importance of treating the Personal Data (as defined below) with privacy. 

(b) This Personal Data Notice (“Notice”) describes how the Company collects, uses and discloses Personal Data that it may obtain through the membership subscription, through the communications between the Management and the Member, through the usage of the Electronic Platform and through other sources such as information obtained from the regulatory agency. 

(c) As required under the Personal Data Protection Act 2010, this Notice is prepared in dual language (English and Bahasa Malaysia) and in the event of any conflict between the English and Bahasa Malaysia version, the English version shall prevail. 

(d) The Company shall have the right to update or amend the terms of this Notice at any time by notifying the Member. By continuing to be the member of the Club following the updates or amendments to this Notice, this shall signify the Member’s acceptance of such updates or amendments. 

(e) By subscribing the membership of the Club, the Member consents to the collection, use and disclosure of the Personal Data and represents that he/she has the full authority from his/her Registered Dependant and guest to permit the Company to collect, use and disclose their Personal Data in the manner provided in this Notice. 

(f) Unless otherwise stated, the Member is obligated to provide the required information particularly during the membership registration and registration of Registered Dependant and guest. Should the Member fail to provide the obligatory information, the Company would be unable to process the Member’s request and/or provide the Member with relevant services, products and facilities. 

(2) The collection of Personal Data and how it will be used 

(a) The personal data of the Member (including his/her Registered Dependants and guests) that the Company may collect includes but not limited to name, address, contact details, personal preferences, particulars of family members, bank account information and any information which may identify the Member (which includes the Registered Dependants / guests (“Personal Data”)). 

(b) The Company may use and process the Personal Data for the purposes relating to the services its offered and for the Company’s business activities which includes but not limited to: 

(i) processing transaction or use of any of the services, products and/or facilities provided by the Club; 

(ii) for internal administrative purposes; 

(iii) complying with legal and regulatory obligations and recommendations; 

(iv) to conduct research and data analytics to enhance the services, products and/or facilities provided by the Club; 

(v) ensuring that the marketing activities and communications are relevant to the Member’s interests which includes customer profiling, targeted advertising, administering promotions, and informing the Member about important notices, events and discounts; 

(vi) ensuring safety and security which includes but not limited to the use of the digital image for the Club’s facial recognition system; 

(vii) other reasonable purposes related to the provision of the services, products and/or facilities at the Club. 

(3) Disclosure to Third Parties 

(a) The Company may engage other third parties to perform functions on the Company’s behalf, and consequently may provide access or disclose to the Personal Data to the third parties such as those listed below (which the list shall not be exhaustive): 

(i) appointed contractors and agents to manage or provide any services, products and/or facilities at the Club; 

(ii) appointed contractors and agents to provide incidental services in relation to the management of the Club such as information technology (IT) service providers and storage facility providers; 

(iii) banks and financial institutions; 

(i) insurance providers; 

(ii) any professional advisors and external auditors, regulatory and governmental authorities in order to comply with statutory and government requirements. 

(b) In the event of a potential, proposed or actual sale of business, disposal, acquisition, merger or re-organisation (“Transaction”), the personal data may be required to be disclosed or transferred to a third party as a result of the Transaction. The Member hereby acknowledges that such disclosure and transfer may occur and permit the Company to release the personal data to the other party and its advisers/representatives. 

(c) The Personal Data may be transferred out of Malaysia, stored, used and processed in a jurisdiction other than Malaysia for the purposes as described above where such third parties are located outside of Malaysia. The Member understands and consents to the transfer of the Personal Data out of Malaysia as described herein. 

(4) Access, correction requests and inquiries 

Subject to any exceptions under applicable laws, the Member may at any time hereafter request (i) for access to the Personal Data; (ii) for correction or rectification of the Personal Data; (iii) to limit the processing of the Personal Data; or (iv) to seek further information from the Company regarding the processing of the Personal Data by contacting:
